Last updated: November, 2025
These Terms and Conditions (“Terms”) govern the relationship between Balancify SIA, a limited liability company registered in the Republic of Latvia, and any individual or organisation that purchases, uses, or participates in the services offered by Balancify. These services include yoga classes, private sessions, workshops, events, retreats, corporate wellness programmes, online classes, digital materials, and any other current or future services provided under the brand Balancify. By accessing the website balancify.eu, booking a service, or attending any Balancify activity, the participant acknowledges and accepts these Terms in full.
1. Introduction and Scope
These Terms apply to all interactions between Balancify and the participant, whether the engagement occurs through the website, in person, online, at a retreat location, or through corporate contracts. The purpose of these Terms is to define the rights, obligations, and responsibilities of all parties to ensure clarity, transparency, and consistent service quality. Balancify reserves the right to update, modify, or amend these Terms at any time. Any change will take effect upon publication on balancify.eu, and the participant is encouraged to review the Terms periodically.
2. Definitions
For the purposes of these Terms, the term “participant” refers to any individual who books, attends, or engages with Balancify’s services. The term “service” refers collectively to all forms of yoga and wellness-related activities provided by Balancify, including regular classes, private sessions, workshops, retreats, online sessions, and corporate engagements. “Website” refers to balancify.eu, through which information is provided and bookings may be processed. “Payment processor” refers specifically to EveryPay (integrated with Swedbank), which handles secure online financial transactions for Balancify.
3. Description of Services
Balancify offers a range of wellness-related activities designed to support physical, mental, and emotional wellbeing. These include group yoga sessions of various styles, individual private lessons, thematic workshops, multi-day retreats both locally and internationally, online classes delivered via digital platforms, and corporate wellness programmes designed for teams and organisations throughout Europe. All services are described on the website for informational purposes only and may evolve over time as Balancify develops new formats or discontinues existing ones. Service descriptions do not constitute contractual commitments regarding the exact structure, duration, or content of any specific class or event.
4. Bookings, Payments, and Confirmation
A booking for any Balancify service is considered confirmed only once payment has been successfully completed. All payments must be made electronically, either through the website or through a secure payment link, using the EveryPay system aligned with Swedbank’s infrastructure. Balancify does not accept cash payments under any circumstances. The participant is responsible for ensuring the accuracy of personal information provided during the booking process. Once a booking is confirmed, the participant will receive a confirmation email containing relevant details. Balancify reserves the right to decline a booking if necessary for operational, safety, or compliance reasons.
5. Pricing, Taxes, and Service Availability
All prices for services are quoted in euros and include taxes where applicable. Balancify reserves the right to change its pricing at any time; however, such adjustments do not affect bookings that have already been completed. Service availability depends on venue capacity, instructor availability, seasonal schedules, and other factors. Balancify may alter, postpone, or cancel a scheduled service when reasonably necessary due to instructor illness, technical issues, unforeseen events, venue unavailability, or force majeure circumstances.
6. Cancellation and Refund Policy for Regular Yoga Classes
Balancify applies a strict cancellation and refund policy for regular yoga classes in order to maintain efficient scheduling and operational stability. Once a booking has been completed, payments are non-refundable. If the booking system allows rescheduling within a specified timeframe, the participant may make such changes independently; however, Balancify bears no obligation to provide alternatives, credits, or special arrangements beyond what is technically supported. Any participant who fails to attend a booked session (“no-show”) forfeits the full fee, and no refunds or substitutes shall be issued.
7. Workshops and Events
Workshops and special events follow the same non-refundable model unless explicitly stated otherwise at the time of purchase. A participant who does not attend a workshop forfeits all rights to refunds or credits. If Balancify must cancel a workshop due to unforeseen circumstances, participants will receive a full refund of workshop fees paid to Balancify; however, Balancify shall not be liable for travel costs, accommodation expenses, or any incidental losses incurred by the participant.
8. Retreat Bookings, Payments, and Refunds
Retreats require full payment either at the time of booking or by the deadline specified for the particular event. Only upon full payment is a retreat participation considered confirmed. Balancify applies a moderate cancellation policy to retreats, recognising the advance planning and logistical commitments involved. If a participant cancels a retreat at least 30 days before its scheduled start, a full refund shall be issued. If the participant cancels between 14 and 29 days before the retreat start date, Balancify shall refund 50% of the retreat fee. If the participant cancels within 14 days of the retreat, or fails to attend without prior notice, no refund shall be issued. Retreat bookings are strictly personal and cannot be transferred or resold to another person.
9. Balancify-Initiated Retreat Cancellation
Balancify reserves the right to cancel a retreat should the minimum required number of participants not be met or if other significant circumstances arise, including illness of the instructor, safety considerations, or venue issues. In such cases, Balancify will issue a full refund of all payments made directly to Balancify. Balancify shall not be responsible for any additional costs incurred by the participant, including but not limited to transport, flights, accommodation, insurance, or any other related expenses.
10. No-Show Policy Across All Services
For all services—regular classes, private lessons, workshops, retreats, corporate sessions, and online classes—non-attendance without prior cancellation results in the full forfeiture of the booking. No refunds, credits, or alternative services shall be provided in the case of a no-show, regardless of circumstances.
11. Non-Transferability of Bookings
All bookings are strictly personal. The participant may not transfer, assign, resell, gift, or otherwise reallocate their booking to another individual. This policy exists to ensure participant safety, accurate registration, and clarity regarding consent, health disclosure, and liability obligations.
12. Health, Safety, and Participant Responsibilities
Yoga requires physical exertion and may involve stretching, balance, controlled breathing, and movements that challenge the body. By participating in any service offered by Balancify, the participant confirms that they are physically fit and capable of engaging in such activities without causing harm to themselves or others. The participant understands that yoga is not a competitive activity and agrees to practise mindfully, respecting personal limits and avoiding overexertion. The participant bears full responsibility for monitoring their physical condition during practice.
It is the participant’s duty to inform Balancify of any relevant health conditions, injuries, chronic issues, medical devices (such as pacemakers), limitations regarding movement, or any factor that may affect safe participation. For retreats, the participant must also disclose dietary restrictions or specific requirements in advance. Balancify cannot be held liable for incidents or complications arising from the participant’s failure to provide accurate or complete health-related information.
13. Assumption of Risk and Limitation of Liability
While Balancify strives to provide a safe and supportive environment, the participant acknowledges that physical activity carries inherent risks. By attending any Balancify service, the participant voluntarily assumes all risks associated with participation, including the risk of injury. Balancify, its instructors, employees, and partners are not liable for injuries that arise through ordinary participation, misuse of equipment, failure to follow instructions, or undisclosed medical conditions. Balancify does not accept responsibility for loss, damage, or theft of personal belongings brought to classes, events, or retreats. Nothing in these Terms shall exclude liability where such exclusion is unlawful under Latvian or EU law.
14. Right to Refuse Participation on Safety Grounds
Balancify reserves the right to refuse or terminate participation if the instructor reasonably determines that the participant’s condition, behaviour, or circumstances pose a safety risk to themselves or others. This right is applied strictly to ensure the welfare and safety of all participants. Balancify does not exercise this right arbitrarily or for commercial reasons.
15. Use of Website and Digital Materials
All content provided on balancify.eu, including class descriptions, images, written materials, videos, and digital guides, is the intellectual property of Balancify SIA. The participant may not copy, reproduce, distribute, or share any digital or online content without explicit written permission. Recording of online classes or retreat sessions is prohibited unless expressly authorised by Balancify.
16. Photography and Video Recording
The Provider may occasionally take photographs or short video recordings of yoga classes or studio activities for marketing purposes, including publication on the Provider’s website, social media accounts and other promotional materials.
The Provider aims to ensure that participants’ faces are not clearly identifiable, unless explicit consent is obtained. Recordings are made in a way that focuses primarily on atmosphere, movement, or the instructor.
By booking and participating in a class, the Client acknowledges that such photography or filming may occur and accepts that they may appear incidentally in visual material, provided they are not the central or identifiable subject of the content.
If the Provider wishes to feature a Client clearly and recognizably (e.g., close-up images, interviews, testimonials), the Provider will request written consent from the Client before publishing such material.
The Client has the right at any time to inform the Provider that they do not wish to appear in any recordings. In such cases, the Provider will ensure that the Client is positioned outside the filming area or blurred/not included in published materials.
All processing of visual material complies with GDPR and Balancify Ltd.’s Privacy Policy.
17. Communications and Notifications
All essential communication from Balancify, including booking confirmations, schedule updates, retreat instructions, and policy changes, will be delivered through email or other contact channels provided by the participant, such as WhatsApp or SMS, where consent has been given. The participant is responsible for ensuring that their contact details are correct and for regularly checking their messages.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Latvia. Any dispute arising from or connected to these Terms shall be subject to the exclusive jurisdiction of the courts of Latvia. Balancify operates as a European company under EU consumer protection and service provision standards.
19. Amendments to These Terms
Balancify may amend these Terms at any time to reflect operational updates, changes in service offerings, compliance requirements, or legal developments. The amended version will be published on balancify.eu and shall take effect immediately upon posting. Continued use of Balancify services following publication constitutes acceptance of the revised Terms.
